Intellectual property

Intellectual property (IP) rights protect “products of the human mind” and give the holder a temporary exclusive right of exploitation for a specific territory. The rights holder is the only party allowed to commercialise, distribute and/or protect the creations in question from third parties. As such, IP rights form an exception to the principle of freedom of trade.

Types of intellectual property

There are two classic categories within intellectual property: industrial and artistic rights.

Industrial property rights protect things of economic importance. Examples include:

  • Patents;
  • Trademarks;
  • Designs and models rights;
  • Plant breeders’ rights;
  • Protection of geographical indications.

Artistic intellectual property rights are aimed at protecting items of primarily artistic significance. Copyright is the most famous example of this and includes:

  • Architectural plans;
    • Design and completion of construction works;
    • Art, such as literary works, photography, film and theatre;
    • Software development and design.

The economic value of intellectual property is becoming increasingly important. This presents challenges, such as combatting counterfeiting and the need for national and international enforcement of intellectual property.
